General Terms and Conditions
1. Booking / Payment
1.1 FZ-Flughafentransfer determines travel routes, departure times and departure locations together with the customer. In principle, there is no entitlement to transport - the decision on whether to accept a transport order rests with FZ-Flughafentransfer and the third parties authorized by them.
1.2 A contractual obligation of the company only arises upon acceptance of the offer and confirmation by FZ-Flughafentransfer by telephone, fax or email.
1.3 Acceptance does not require any specific form. At the express request of the customer, the contractual performance can be confirmed in writing by fax, post, telephone or email in an order confirmation.
1.4 Payment for passenger transport services is due after the service has been provided, either in cash, by debit or credit card or by invoice following prior agreement.
1.5 FZ-Flughafentransfer is obliged to inform the customer immediately of any changes to services and prices. If necessary, the customer will be offered a free cancellation.
2. Promotion / Performance
2.1 The previously agreed pick-up times and addresses are binding. The specified pick-up time can differ by 30 minutes. If the vehicle is not at the departure point at the agreed pick-up time + 30 minutes, the customer is obliged to inform FZ-Flughafentransfer by calling +491705533177.
2.2 If the vehicle is not at the airport at the specified time, or if the driver and customer miss each other, FZ-Flughafentransfer must be notified via the airport information.
2.3 No liability is accepted for incorrectly stated addresses, flight numbers, departure, arrival or pick-up times, including for any resulting consequential damages.
2.4 FZ-Flughafentransfer is liable within the scope of its duty of care for the conscientious preparation and proper provision of the transport. Liability for breach of contract and tort is limited to intent and gross negligence.
2.5 There is an exclusion of liability for delays caused by force majeure. This includes bad weather, vehicle traffic jams, accidents, breakdowns, third-party fault. This also applies to exceptional situations that can lead to delays or even cancellations, such as strikes, civil unrest, natural events and other disasters (force majeure). In all other cases, liability is limited to the additional costs for replacement transport on the booked route by an alternative transfer company.
3. Cancellation by customer
3.1 The customer can cancel up to 12 hours before the pick-up time by FZ-Flughafentransfer. However, the customer is obliged to report the cancellation as soon as possible.
3.2 If the booked transfer is not used without cancellation, 100% of the transfer price will be due and must be paid by the customer.
4. Staff shortage / Vehicle defect
4.1 In the event of a shortage, for example due to staff being reported sick at short notice or due to a vehicle defect, FZ-Flughafentransfer reserves the right to pass the order on to a partner company in order to avoid having to cancel the agreed transfer or, if necessary, to cancel it.
4.2 If a partner company can step in in this exceptional situation, the booking data will be forwarded accordingly so that the partner company can also carry out the order. This does not change the agreed conditions.
4.3 If, in this exceptional situation, no partner company can be found that still has free capacity and the order actually has to be cancelled, the customer will be informed of the situation immediately. If the fare has already been paid online, the customer will of course receive the amount back immediately.
5. General
5.1 The General Terms and Conditions (GTC) apply to contractual relationships between FZ-Flughafentransfer and the client for the transport of persons in rental car traffic.
5.2 The customer is liable for any damage to the vehicle caused by the customer. This includes cleaning the vehicle inside and out, as well as liability for damage to the paintwork and interior fittings if this was caused intentionally, through gross negligence or as a result of excessive alcohol consumption.
5.3 Persons and objects that endanger the safety of other ferry passengers and the crew are excluded from transport. No liability is accepted for objects left in the vehicle or lost.
5.4 The customer agrees to the general terms and conditions of FZ-Flughafentransfer upon conclusion of the contract, as described above. Any agreements deviating from these general terms and conditions are only valid if they have been agreed in writing. Verbal agreements are not permitted. Should individual provisions of this contract be or become invalid or void in whole or in part, this shall not affect the validity of the remainder of the contract. The parties undertake to replace the invalid or void provision with a valid provision that comes closest to the intended economic purpose. The same applies in the event of a gap.
